The Swedish Administrative Court of Appeals has dismissed Cherry’s appeal against Spelinspektionen’s decision to curtail the operating permit of its subsidiary for a two-year period.

Cherry had previously contested Spelinspektionen’s ruling last year to issue its subsidiary Co Gaming a two-year operating permit, encompassing its seven brands.

The operator subsequently challenged the decision, but the Administrative Court of Linköping rejected its appeal, concluding that Spelinspektionen had the authority to restrict the license duration.

Cherry then appealed to the Administrative Court of Appeal in Jönköping, but the court once again sided with the regulatory body.

This unsuccessful appeal follows Mandalorian Technologies, owned by Paf, announcing this week that it had successfully appealed a penalty that reduced its Swedish license period for breaching bonus regulations.

The operator’s license was reduced from five years to two years due to its offering bonuses to players multiple times after they signed up on its platform.

However, while the Administrative Court of Linköping determined that the SEK 9 million (£787,296/€870,343/$1 million) fine levied on Mandalorian Technologies should remain, it stated that the license should be extended to three years.

The Swedish Gaming Authority recently clarified its position on licensing conditions, outlining how the financial health of licensees impacts their permits in Sweden. In 2019, some license seekers were granted only one-year licenses due to their subsidiaries’ indebtedness. However, after several operators appealed, their licenses were extended from two to three years. The Swedish Gaming Authority stated that it would use the court’s decision as a model for future licensing choices. Sign up for the iGaming news bulletin.
